1.0 Introduction
Thank you for your interest in Property Three. We hope your visit to our
web site is pleasant and productive. Your right to privacy while using the
Internet and visiting Property Three web sites is very important to us.
We respect your privacy and are committed to protecting it.
Property Three provides this Internet privacy statement to inform you of
our privacy policy and practices and of the choices you can make about the
way your information is collected and used. This privacy statement applies
to all Property Three web sites and domains.
This privacy statement covers personally identifiable information, anonymous
data collection, and aggregate reporting. Personally identifiable information
is any information that is associated with your name or personal identity.
Anonymous (non-personal) information is data about usage and service operation,
reported in aggregate, which is not associated to a specific personal identity.
Aggregate information is data collected and summarized for a broad category
of customers. This privacy statement applies solely to information collected
by Property Three web sites.
2.0 Your consent
By using Property Three web sites, you consent to the collection and use
of your information by Property Three as set forth in the privacy policy
currently in effect. If we change our policy, such changes will be posted
here on the web site, so it is important that you check back periodically
to ensure you have access to the most current privacy policy.
3.0 Anonymity
Property Three web sites have been designed so that you can visit any web
page on our Sites without identifying yourself or revealing any personal
information. When you enter our web sites we can determine your domain name
and what browser and operating system you are using, but we cannot determine
any personal information about you.
4.0 What information is collected and how is it collected?
Note: If you are not familiar with the meanings of terms such as "cookies",
"clear gifs", "web beacons", and "web bugs",
refer to Section 4.3.
4.1 Anonymous (non-personal) information via log files
Property Three may use log files to collect anonymous (non-personal) information
such as visitor internet protocol (IP) addresses, browser type, internet
service provider (ISP), referring/exit pages, platform type, date/time stamp,
number of visits, average time spent on pages, and number of clicks to analyze
trends, administer the site, track user's movement in the aggregate, and
gather broad demographic information for aggregate use. (IP addresses, etc.
are not linked to personally identifiable information.) We use this collected
information to measure the use of our Sites and to improve the content of
our Sites. Most anonymous data is collected via cookies, web beacons, and
other technologies for data analysis and personalization services.
4.2 Personal information supplied by visitors
When a visitor to a Property Three web site submits to Property Three
a request for more information, chooses to enter our sweepstakes drawing,
or asks us to respond to a question, the visitor is required to provide
us with personal information. The types of personal information you
provide to us on these pages may include your name, company name,
address, phone, e-mail address, user IDs and passwords, and contact
preferences. We use this information to contact the user and/or send
materials about the services on our Site for which he/she has expressed
interest.
To personalize our web sites, services or communications and improve our
products and services, we may also ask you to provide us with information
regarding your personal or professional interests, demographics, and experiences
with our products or services. We may ask questions about the primary business
and size of your company, your professional role, or what products you currently
use so that we can better tailor our web site and content to provide what
you're looking for. Each online form will clearly specify which information
is required and which is optional.
Property Three may send cookies and/or clear gifs when you surf our
Sites or request information. Your acceptance of any cookies or clear
gifs used on our web sites does not give us access to your personal
information.
Property Three may contract with third party companies to perform services
for Property Three on its web site that require these companies to collect
personal information (e.g. hosting a web site sweepstakes, sales promotion,
or marketing surveys). The Property Three web site may also contain various
links to third-party web sites. These sites may provide additional information,
goods, services and/or promotions. These sites are owned and operated independently
of Property Three and have their own separate privacy and data collection
practices. Any information you provide to these web sites will be governed
under the terms of their privacy policy, if any. Property Three has no responsibility
or liability whatsoever for the independent actions or policies of these
independent sites, and is not responsible for the content or privacy practices
of such sites.
Wherever Property Three collects personal information we try to include
a link to this Privacy Policy on that page.
4.3 Cookies, clear gifs, web beacons, and web bugs
A "cookie" is a small data file transferred by a web site to your
computer's hard drive. Two types of cookies are in common use: persistent
cookies and session cookies. A persistent cookie is a file stored on the
user's hard drive for an extended period of time. (Persistent cookies can
be removed by following Internet browser help file directions.) Session
cookies, on the other hand, automatically are terminated once the user leaves
a web page or closes the browser.
You are always in control of what cookies, if any, you accept via settings
within your browser. By modifying your browser preferences, you have the
choice to accept all cookies, to be notified when a cookie is set, or to
reject all cookies. If you choose to reject all cookies you will be unable
to use those services or engage in activities that require the placement
of cookies.
You can find information on popular browsers and how to adjust your cookie
preferences at the following web sites:
Microsoft Internet Explorer: http://www.microsoft.com/info/cookies.htm
Netscape Navigator: http://www.netscape.com/legal_notices/cookies.html
A clear gif -- also known as a Web Beacon, a Web Bug, or a single-pixel
(1x1) gif -- is a tiny electronic image that is placed on your hard drive
in a manner similar to the placement of a cookie. The main difference between
a clear gif and a cookie is that clear gifs are invisible on the page and
are much smaller, about the size of a period at the end of a sentence.
Clear gifs can work with existing cookies on a computer if they are both
from the same web site or advertising company. For example, if a person
visited "www.website.com", which uses an advertising company's
clear gif, the web site (or advertising company) would match the clear gif's
identifier and the advertising company's cookie ID number, to show the past
online behavior for that computer. This collected information would then
be given to the advertising company or web site owner.
Clear gifs may also be used in HTML-based e-mails to let the sender know
which e-mails the recipients have opened. This allows the gauging of effectiveness
of certain communications and the effectiveness of marketing campaigns.
Users are allowed to opt-out of these e-mails.
Clear gifs may be rendered unusable by rejecting their associated cookies.
5.0 How we use your information:
5.1 Anonymous (non-personal) information via log files
Property Three may perform research on our users' demographics, interests,
and behavior based on the information provided to us via non-personal log
files. Anonymous (non-personal) data may be aggregated for research purposes,
compiled, and analyzed on an aggregated basis that prevents the identification
of personal information relating to a single individual. The purpose of
such research is to improve the customer experience, site usability, and
site content. We may share this aggregated data research with our business
partners.
Property Three may also disclose aggregated user statistics in order to
describe our web site to prospective business partners, advertisers, and
other third parties, and for other lawful purposes.
5.2 Personal information supplied by visitors
In order to respond to requests you make to us, it is necessary that we
know your name and one or more of your e-mail address, phone number, company
name, and mail address.
Your personal information may be used to make sure you received what you
asked for, and to provide you further information about product features,
upgrades, specials, and support. We also use personal information to better
understand your needs and interest and provide you with better service.
Occasionally we may use your information to contact you for market research
regarding Property Three products or services. (You will have the opportunity
to opt-out of these market research and customer surveys.)
On certain types of Property Three promotions, we will ask for your e-mail
address in order to contact you in the event you have won a prize. When
you participate in these types of promotions, you may receive promotion-related
e-mail. Occasionally these promotion-related e-mail messages may include
targeted advertisements. If you do not wish to receive such advertisements,
you can choose not to participate in such promotions or contests.
Property Three may combine the personal information you provide us with
information available from other sources, including offline sources such
as industry directories and information you provide through other sources
including public events such as trade shows or seminars to market new products
or services we think may be of interest to you.
6.0 Your choices regarding collection, use, and distribution of your
information
Property Three web site visitors are given the opportunity to 'opt-out'
of having their information used for purposes not directly related to our
site at the point where we ask for information. For example, our literature
request form has an 'opt-out' mechanism so those who don't want to receive
any future marketing materials can keep their e-mail address off of our
lists.
Property Three or its business partners may, from time to time, send you
e-mail or U.S. mail regarding our products and services. Out of respect
for the privacy of our users, we present the option to not receive these
types of communications. If you do not want to receive such information,
simply tell us when you give us your personal information, or follow the
directions contained on the materials to remove your name from our mailing
list.
7.0 Confidentiality
Property Three is the sole owner of the information collected on Property
Three web sites. Property Three will not sell, rent, or lease nor otherwise
share your personally identifiable information (name, telephone number,
postal address, e-mail address, etc.) with any other company or organization
that is not an Property Three business partner. Once you choose to provide
us with personal information, you can be assured that it will only be used
to support your customer relationship with Property Three. (It is Property
Three's policy to periodically follow-up with customers who have requested
information from us to make sure such requests have satisfied the requester's
needs.)
Property Three may also disclose personal information in special cases when
we have reason to believe that disclosing this information is necessary
to identify, contact or bring legal action against someone who may be violating
this Site's Terms of Use or may be violating Property Three's or other's
rights or causing injury to or interference with Property Three's or other's
property. Property Three may also disclose or access personal information
when required by law wherein we have a good-faith belief that such action
is necessary to comply with a current judicial proceeding, a court order,
law enforcement action, or legal process served on our web site.
Property Three maintains all personal information attained via the Internet
on a password-protected database in our Indianapolis headquarters. Only
key members of the Property Three team may access this database.
Local country laws and policies are applied where they differ from those
in the U.S.
8.0 Sharing
Property Three may share your personal information on a limited basis with
certain third parties that may perform the function of Property Three sales
representatives. Property Three may also share your personal information
with third-party business partners so that they may provide services to
Property Three that are consistent with the terms of this Privacy Policy,
and this web site (e.g. database management, sending targeted e-mails, sending
letters via U.S. mail, and conducting sweepstakes and other promotions on
behalf of Property Three).
Except as outlined in this privacy policy, Property Three will not provide
your personal information to third parties without your consent.
Users of our site are notified when their information is being collected
by any outside parties. We do this so our users can make an informed choice
as to whether or not they should proceed with services that require an outside
party.
9.0 Links
This web site may contain links to other sites. Please be aware that Property
Three is not responsible for the privacy practices of such other sites.
We encourage our users to be aware when they leave our Site and to read
the privacy statements of each and every web site that collects personally
identifiable information.
Any links provided on Property Three web sites to third party web sites
are provided as a convenience and Property Three does not control those
sites or their privacy practices, which may differ from ours. Property Three
does not endorse or make any representations about any linked sites. We
encourage you to review the privacy policy of any company before submitting
your personal information. The personal data you choose to give to unrelated
third parties is covered by their privacy policies, not the Property Three
privacy policy. Some third-party companies may choose to share their personal
data with Property Three; that sharing is governed by that third-party company's
privacy policy.
10.0 Correcting/updating/deleting/deactivating personal information
If a user's personally identifiable information changes (such as zip code,
phone, e-mail or postal address), or if a user no longer desires communications
with us, we provide a way to correct, update or delete/deactivate users'
personally identifiable information. If you would like to review, correct
or change any personal information you have provided, or remove your name
from our mailing list, please e-mail us with a detailed request at privacy@PropertyThree.com
or contact us at the U.S. mail address listed in Section 14. (See also:
opt-out procedures in Section 14.)
11.0 Notification of changes
If we change our privacy policy, we will post those changes to this privacy
statement, the homepage, and other places we deem appropriate so our users
are always aware of what information we collect, how we use it, and under
what circumstances, if any, we disclose it. We will use information in accordance
with the privacy policy under which the information was collected.
If, however, we are going to use users' personally identifiable information
in a manner different from that stated at the time of collection we will
notify users via e-mail. Users will have a choice as to whether or not we
use their information in this different manner. However, if users have opted
out of all communication with the Sites, or deleted/deactivated their account,
then they will not be contacted, nor will their personal information be
used in this new manner. In addition, if we make any material changes in
our privacy practices that do not affect user information already stored
in our database, we will post a prominent notice on our web site notifying
users of the change. In some cases where we post a notice we will also e-mail
users, who have opted to receive communications from us, notifying them
of the changes in our privacy practices.
12.0 Security
No data transmission over the Internet can be guaranteed to be 100% secure.
For that reason, while we make every effort to protect your personal information,
Property Three cannot ensure or warrant the security of any information
you transmit to us or from our web site, and therefore, you use our Site
at your own risk. Once we receive your information, we use our best effort
to ensure its security on our systems. To prevent unauthorized access or
disclosure, maintain data accuracy and ensure the appropriate use of the
information, Property Three has in place appropriate physical and managerial
procedures to safeguard the information we collect.
13.0 Child privacy issues
Property Three web sites are intended for use by persons over the age of
13. Property Three does not knowingly collect information from children
under the age of 13 and our products and services do not target information
to children under 13. No information should be submitted to or posted on
the Property Three sites by users under 13 years of age. If a child under
the age of 13 submits personal information to our web sites, we delete the
information as soon as we discover it and do not use the information for
any other purpose.
Property Three encourages parents to take an active role in their children's
use of the Internet and to inform their children of the potential dangers
of providing personal information about themselves over the Internet.
